Overview:
All our products and services serve to make people more successful, happier and healthier. On the one hand, our expertise is based on studies and university degrees and on the other hand of coaching as an athletic and mental coach, team developer and management trainer at the highest international level. All our experiences we involve into the management trainings for companies and individuals – for all those who want to achieve extraordinary success in their areas.
General provisions:
These terms and conditions apply to all services, events, seminars, training camps, courses, coachings, lectures and as well products such as books, i-books, MP3 files, various disks, downloads … for consumers, entrepreneurs and persons of public right. The inclusion of other terms and conditions is expressly prohibited unless Winning has given its written consent. The acceptance of our services by you is considered as a recognition of our terms and conditions. At the same time you abandon the validity of your own terms and conditions.
Registration and conclusion of contract:
You can register in writing via our online form or by e-mail (office@winning.at) for our services. Your registration will be considered according to the order of receipt. Upon receipt of your registration you are bindingly registered for the desired service. This represents a binding offer for us to conclude a contract. The contract is only concluded by our confirmation of your registration, whereby as a legally binding booking the submission of your registration is sufficient. If the service is carried out without you having previously received an order confirmation, then the contract is concluded at the beginning of the execution of the event.
Type and volume of the service:
The contractually agreed services are set out in the service description of the respective event/service according to the brochure or on our website at www.winning.at
Subject to change:
We reserve the right to make necessary changes in content and/or organization before or during the seminar event/service – if these do not substantially change the overall character of the seminar/service. If necessary, we are entitled to replace the initially provided speaker by qualified persons.
Reservation:
Hotel reservations are made by and for the account of the seminar participant/company. The contractual relationship is concluded exclusively between the seminar participant/company and the hotel. On request, a pre-booking of Winning is made. The hotel reservation must be made directly by the seminar participant or the company.
Terms of payment:
Our prices (errors excepted) are understood to be exclusive of VAT, unless otherwise quoted. The fee includes, for example, services for planning and conducting seminars/training courses. Also included are on-site support and any relevant documentation. The invoices provided by Winning are payable promptly and without any deduction. For partial invoices, the terms of payment apply as well. In case of late payment 8% interest p. A. agreed as default charges.
Cancellation policy:
You can resign at any time before and during the seminar/service. To avoid misunderstandings a written declaration of resignation is necessary. Up to six weeks before the start of the event, we will charge a processing fee of 20% of the training fee for all program preparations and expenses. For cancellations from the 41st to the 10th day 50%, from the 9th to the 3rd day 70% and from the 2nd day until the beginning of the event 100% of the total amount. There will be no refund of the price paid by the customer for premature break off by the customer or at its delayed appearance, no matter for whatever reason.
Withdrawal:
You have the right to withdraw your registration within 14 days of the date on which you have registered, without giving any reason. In order to exercise your right of withdrawal, you must inform Winning in writing of your decision to withdraw your application. Submit your statement as an e-mail to office@winning.at. We will send you a confirmation of receipt of such withdrawal. If services have already been used by us, they will be charged by us.
Consequences of the cancellation:
If you revoke your registration within the revocation period, we will refund all payments that we have received from you and that you have not used yet, from our notice of your revocation within 14 days. We use the same form of payment that you used in the original transaction. Unless explicitly agreed otherwise with you. We will not charge you any fees for the repayment unless we started already delivering our services/products. In this case, the service/product will be charged.
Cancellation of seminars/services/events:
We reserve the right to cancel or postpone our events/services due to insufficient demand or number of participants, force majeure or illness of a speaker. Of course, Winning will notify you promptly and refund you the fee paid promptly. Liability and damage claims are excluded unless intent or gross negligence on our part.
Refusal and exclusion of participants:
We reserve the right to refuse an event booking (single participation or company) without giving reasons. In this case, of course, any fees already paid will be fully refunded.
Participants who repeatedly disrupt the course of an event and do not comply with the rules of the presenter, abuse the event to recruit people or sell third-party products, can be excluded from us. In this case, the full event price still has to be paid.
If participants of our events/services do not use our services as a result of delayed arrival, early return journey, illness or for other reasons for which the organizer is not responsible, there is no refunding, even no partly refund.
Audio and video recordings:
At events, foto, video and audio recordings are made as part of training reflection. By attending the event, you are granting Winning the permission to use these fotos and records privately and commercially. A claim to commissions or other payments is excluded, unless otherwise agreed in writing.
You have the right to object to this authorization in advance. In this case, however, you would have to expect a (partial) exclusion from the event, because the video recordings are used for personal or group reflection and thus are part of the training/education. If in doubt, we ask you to contact us in advance to find a common way in the course of our service.
Health and resilience:
In the course of our training programs, it is methodically necessary to physically or mentally leave the personal comfort zone in between. In this regard, physical health and physical and mental capacity is required to participate in these exercises.
The participant confirms that he is healthy and physically and mentally resilient at the start of the event and is not impaired by the intake of medication or similar. In the case of an impairment, the participant must notify this to Winning ahead of time.
A participation of the event is usually possible after consultation with Winning – but without participation in the physically or mentally demanding exercises. A participation in the exercises is generally not mandatory and is always based on personal decision of the participant.
Liability:
All training measures, training plans, methodologically pedagogical and psychological contents are carefully selected, tested and meet a high international standard. Some training programs are very innovative and therefore incomparable and have proven themselves in international top-class sport and management.
The depth of the involvement in change processes (self-experience) determines the participant himself and he/she is responsible for it.
Experience has shown that the training goals of our participants are constantly being achieved or even exceeded. Nevertheless, Winning accepts no liability in the achievement of the goals aimed by the participant or a team/group.
The disclaimer applies to damages and consequential damages caused by incorrect planning or incomplete event execution or e.g. wrong coaching of a trainer. The disclaimer applies also, if the behavior of an participant of the event leads to damage or consequential damage of another participant. Safety is our highest concern. Therefore, all exercises are implemented, secured, supervised and carried out to the best of our knowledge and belief by experts (e.g. state-certified mountain guides, sports scientists, psychologists, educators, doctors …).
Claims for compensation for damage to property in accordance with the Product Liability Act are excluded. Winning reserves the right to exclude liability for property damage under the Product Liability Act when using equipment in areas that can be expected to cause particularly high compensation claims in the event.
Insurances can be offered on site in the course of the event, if subcontractors do not grant corresponding insurance cover anyway.
The liability of Winning is limited to deliberate action and gross negligence.
The participant of an event is aware and accepts that it is not possible – according to the state of the art – to completely exclude defects in the materials or machines used under all conditions of use.
Participation in practical exercises indoor or outdoor including physical performance tests is at your own risk.
Subcontractors:
Subcontractors (e.g. mountain guides, outdoor trainers, sports scientists, business trainers, rafting companies, quad or motorcycle rental companies, etc.) booked by Winning are liable for their services or products. Subcontractors agree expressly to our terms and conditions after placing the order.

Jurisdiction:
For all disputes arising from this contractual relationship, the relevant court in Graz is agreed.
Salvatorius clause:
These terms and conditions remain binding even in the case of legal invalidity of individual clauses or parts of the terms and conditions. Changes or additions to these conditions must be made in writing.
